Terms and conditions
of the cell phone prepaid service
The following are the terms and conditions that apply to the mobile phone prepaid mobile service.
Responsibility
for Charges: You are responsible for all charges related to the Service, including all charges for airtime units, fee of additional features and any charges relating to the reactivation of the Service. You are also responsible for all charges related to the purchase of the handset and accessories.
Suspension/Re-activation
Fees: If you do not recharge any airtime minutes in your prepaid cell phone for a period of 120 consecutive days, your cell phone and number will be put out of service. To re-enrol in the Télébec Mobilité prepaid digital cellular service, you have to go to your local Télébec Mobilité Centre Cellulaire Plus or authorized dealer and pay a re-activation fee of $35. Upon re-activation, you will be issued a new cell phone telephone number.
Terms of Payment:
If you have signed the prepaid recharge authorization form, Télébec
Mobilité will automatically debit all amounts related to the
purchase of air time on the credit card mentioned on the form.
Use of the Service:
You may not use the Service for an illegal purpose, for violating the
law, or for interfering with others' use of the Service. You may not
transfer the Service nor this Agreement to anyone else, and you may
not reproduce, change, or tamper with the electronic serial number (ESN)
on your handset or allow anyone else to do so.
Telephone Number:
Telephone numbers are limited, and you cannot own them. You may be required
to change the number assigned to you at any time, though we will take
reasonable measures to provide you with prior notice. You will lose
your assigned telephone number if you terminate your cell phone service or if your account remains inactive for over 120 days.
Termination of
Service by customer: At any time, you can put an end to this agreement.
Télébec Mobilité will cancel the service within
24 hours following your request and you will be responsible for
all service charges up to the moment the service is cancelled . You
will not be reimbursed for the remaining time units.
Termination of
Service by Télébec Mobilité: Your service may be
suspended or terminated immediately, without notice, if you misuse or
abuse the Service, or if you breach any other terms herein. Your service
may also be suspended or terminated immediately and without notice if
Télébec Mobilité has to preserve the integrity
of the network, or comply with any law and or tariff. You will not be
refunded for any unused airtime.
Limitation of Liability:
Télébec Mobilité cannot guarantee uninterrupted
working of the Service or of the handset, and shall have no liability
to you if the handset or the Service fails or is interrupted, disconnected,
unsatisfactory or unavailable for any reason. Télébec
Mobilité will have no liability, to you and/or any third party,
for any special, incidental, indirect, consequential, exemplary or punitive
damages, including without limitation, loss of revenue, profit, property
or use, caused directly or indirectly as a result of any failure or
performance hereunder, whether due to the negligence of Télébec
Mobilité or otherwise, even if Télébec Mobilité
has been advised in advance of said possibility. Télébec
Mobilité gives no legal or conventional warranty with respect
to the handset or handset accessories. Any warranty with respect to
the handset or handset accessories is limited to the manufacturer's
warranty.
Modifications:
Télébec Mobilité may modify the charges for the
Service and these terms and conditions. Télébec Mobilité
will inform you of these changes as soon as possible, and you agree
that you will be liable for any modified charges and subject to any
modified terms as soon as they come into force.
Returns: In the event of repair or replacement, please visit your local Télébec Centre Cellulaire Plus or authorized dealer.
